Harmony Gold doesn't have any interest in non-profit free mods like MWLL and Mektek. Nobody even knows or cares about Robotech these days (it's pretty much a dead franchise), and the only reason why HG is looking to snag some legal action is to make a quick buck off of it. There's no real competition to be had, and there's no real amount of money they can get off a non-profit project so perhaps that is why stuff like Mektek and us can get away with it (or ask for permission and they be fine with it).
There's actually quite a bit that can go wrong if you don't protect your property properly against "not for profit" projects and why there is the clear danger of mods getting "foxed". Even if there's no money, there is still danger of damage of similar products (Halogen vs Halowars, AvP mods, Jurassic Park mods, Goldeneye Source mod, etc) that can be decided are infringing on copyrights. That was the whole reason we asked in the beginning and why it's proper for Mektek to still receive permission especially now they are releasing their mekpaks with MW4:Mercs for free. In this case of Harmony Gold giving Mektek permission to use the mechs, yes they might not care because it's non-profit, but it will further embed into peoples mind that when they play the MechWarrior, they will see a property that should not belong. It will have the staple mechs that helped make Battletech fairly popular even though they are a support piece and not all that important in Macross.
Also, just because Robotech is practically dead here in the states, doesn't mean it is internationally. Macross is still going strong and with Macross Zero recently, plus Robotech Shadow Chronicles coming out a few years ago.
